Attorney Phoebe Stone of Phoebe Stone Law will present Trustees and Estate Planning in the Era of Home DNA Test Kits. 

Attorney Zach Bloxham of Sandberg, Stettler, & Bloxham (SSB Law), will present Trust Administration: Duties of Attorneys. Attorney Zach Bloxham practices in areas of trust-based estate planning, Medicaid, VA, and appellate litigation, he also serves on the Layton City Council. He is a graduate of Gonzaga University.

Ethics of Client Incapacity

Pamela A. Harbeson, Esq., with the Massachusetts Office of the Bar Counsel will address ethics related to client incapacity in estate planning. Can the client grant permission to the attorney in advance to speak to a named individual, whether the person is named in a durable power of attorney or another person, if the attorney suspects the client may be losing capacity?  Can or should you speak to family members and when - Spouse versus children?

Remote Notarization

Tucker Dulong, Esq., Massachusetts Title Counsel to CATIC (Connecticut Attorneys Title Insurance Company) Title Insurance will give a presentation on the newly passed Massachusetts remote notarization law, including how to comply with the issues related to the act.

Unexpected Estate Inclusion by the Massachusetts Department of Revenue (DOR)

Chris Anasoulis, Esq., of Lisa, Poloski & Anasoulis LLP, will speak on how the Massachusetts DOR has been attacking a common estate planning technique used by many married clients, resulting in a surprise estate tax when the surviving spouse dies.  Under the attack, the DOR is including 50% of the value of the primary residence into the surviving spouse's estate even though the entire property was owned by the deceased spouse's credit shelter trust.  Come and learn about the details of the DOR’s position and how to minimize the risk to your clients.
